About Getting an Annulment

An annulment is similar to a divorce in a very important way: it ends a marriage. However, unlike a divorce, an annulment declares the entire marriage to be null and void. In essence, an annulment makes it as if the marriage never happened in the first place, and the marriage is completely erased.

In some circumstances, there are advantages to seeking an annulment instead of a divorce. Why doesn’t every couple get an annulment? Not every couple is eligible to get their marriage annulled. Here, our Long Island annulment lawyer explains what you need to prove to get an annulment and provides a brief overview of the advantages of getting one.

What are the Grounds for Annulment in New York?

Under New York state law (DOM § 140), you must meet one of several criteria to be eligible to obtain an annulment. While New York allows couples to seek a ‘no-fault’ divorce on the grounds that they have irreconcilable differences, couples can only obtain an annulment if they meet certain standards. More specifically, to get your marriage annulled in Long Island, you must be able to prove one of the following things:

  1. At least one partner was under 18 years old at the date of the marriage;
  2. At least one partner was mentally incapable of consenting to the marriage;
  3. At least one of the partner is currently mentally ill and has been so for five years;
  4. At least one spouse is physically incapable of having sex; or
  5. The marriage was invalid due to fraud, duress, coercion, or a violation of state law.

If you are considering getting an annulment, but you are not sure that you are eligible, you should speak to an experienced Long Island divorce attorney. A lawyer will be able to conduct a comprehensive review of your case.

I Am Eligible for an Annulment: Is it Actually the Best Option?

If you are eligible for an annulment, it might be the best option in your case. With an annulment, the rules regarding division of property and division of debt are different than they are in traditional divorce cases. For some people, an annulment offers financial advantages. In addition, an annulment may also allow for the restoration of certain benefits which the act of marriage initially eliminated.

Finally, it is worth mentioning that some people prefer annulment over divorce for religious, spiritual, or psychological reasons. Ultimately, these issues all must be assessed on a case-by-case basis. If you are weighing getting an annulment versus getting a divorce, you should seek guidance from a skilled Long Island annulment lawyer who can help you take the best action to protect your legal rights and financial interests.

Knowledge

Matrimonial and family law changes often. New developments come out of Albany every year, and the courts implement the law in sometimes surprising ways. To effectively protect your interests, you need a lawyer who understands the latest developments in the law, however minor. We stay informed of upcoming amendments and trends in the law. We know the latest court decisions coming from remote counties that might impact how a judge decides a case here in Long Island. If there is a prior case out of the Family Courts that helps you, we will find it and bring it to the attention of the judge.

Experience

Family law disputes are not like other lawsuits. These disputes are governed by different laws and different judges. Although you can ask a criminal defense lawyer or an immigration attorney to handle your matrimonial or family law dispute, you should not be surprised if they are soon in over their heads and unable to provide effective representation. At Petroske Riezenman & Meyers, our attorneys and support staff have dedicated their careers to excellence and professionalism in the practice of matrimonial and family law.
