WHEN CAN I APPEAL A COURT DECISION?

According to New York Courts, an appeal is heard by a higher court (called an appellate court) and serves the purpose of re-examining part of the original case that the person who filed the appeal (the appellant) believes to be erroneous. While you cannot simply appeal a court decision just because it was not in your favor, you can appeal if there is reason to believe that something did not go right, legally. These court errors and other reasons for an appeal include:

  • Misinterpretation of the law;
  • A revelation made from new facts;
  • Lack of evidence supporting the court decision;
